Rental Terms & Conditions

1. Scope

These terms and conditions apply to every reservation and rental agreement between Lazy Jane Curaçao (hereafter: "the owner") and the guest for the stay at Lazy Jane villa, located in Vista Royal, Jan Thiel, Curaçao.

2. Reservation & confirmation

A reservation is finalised when the owner confirms availability by e-mail and the guest has paid a deposit of 25% of the total amount. Until that moment, a request can be placed as an option; options expire automatically after 48 hours if no deposit is received.

3. Payment

• 25% of the total rental amount within 7 days of reservation.
• Remaining 75% at the latest 8 weeks before arrival.
• For reservations made within 8 weeks of arrival the full amount is due immediately.
• A security deposit of € 1,500 is paid upon arrival (cash or bank transfer) and refunded within 14 days after departure, less any damages, excess utility consumption or additional cleaning costs.
• All amounts are exclusive of 7% local turnover tax (OB).

4. Cancellation by guest

The following cancellation schedule applies:

• Cancellation more than 8 weeks before arrival: 25% deposit is forfeited.
• Cancellation between 4 and 8 weeks before arrival: 50% of the total amount due.
• Cancellation between 2 and 4 weeks before arrival: 75% of the total amount due.
• Cancellation within 2 weeks of arrival or no-show: 100% due.

We strongly recommend taking out a travel and cancellation insurance.

5. Arrival & departure

• Check-in: from 16:00 on the arrival date.
• Check-out: before 11:00 on the departure date.
• Key handover is in person; the owner or villa manager will welcome you at the villa.
• Earlier or later arrival/departure only on request and subject to availability.

6. Use of the villa

• The villa accommodates a maximum of 15 guests. Additional persons are not allowed without prior written consent.
• Smoking is only allowed outside.
• Pets are not allowed unless agreed in writing in advance.
• Parties or events with third parties are not allowed without prior written permission.
• Guests are expected to respect the rules of Vista Royal and the neighbours (no noise after 22:00).

7. Damage & liability

The guest is liable for any damage to the villa, furniture, inventory and garden during the stay, with the exception of normal wear and tear. Damage must be reported immediately to the owner or villa manager. The security deposit may be used to cover damage.

The owner is not liable for theft, loss or damage to guests' belongings, nor for personal injury or accidents on the premises, except in cases of intent or gross negligence on the part of the owner.

Pool use: the pools are not fenced or permanently supervised. Parents and/or guardians are responsible for the supervision of children at all times.

8. Cleaning

• Final cleaning (€ 425) is mandatory and arranged by the owner.
• Mid-stay cleaning (€ 225) is mandatory for stays longer than 7 nights and is performed at least once a week.
• The guest leaves the villa tidy upon departure; waste in the designated bins.

9. Force majeure

In case of force majeure (including natural disasters, hurricanes, flight closures, government measures) preventing the stay in whole or in part, the owner will make reasonable efforts to reschedule the stay or offer a suitable solution. Refunds are not automatic and depend on the specific situation.

10. Complaints

Complaints about the villa or services must be reported directly to the owner or villa manager during the stay so a solution can be sought. Complaints submitted after the stay will no longer be processed.

11. Applicable law

These terms are governed by Dutch law. Disputes will be exclusively submitted to the competent court in the district where the owner is established.
